Aggravated Sexual Assault Against Another Adult

Aggravated sexual assault against another adult occurs when a person intentionally or knowingly commits one of the following actions:

  • Causes the penetration of the mouth of another person by the sexual organ of the actor without that person’s consent
  • Causes the penetration of the sexual organ or anus of another person by any means without that person’s consent
  • Causes the sexual organ of another person, without that person’s consent, to contact or penetrate the mouth, anus, or sexual organ of another person, including the perpetrator

Aggravated Sexual Assault Against a Child, Elderly Person, or Disabled Individual

Aggravated sexual assault against a child, elderly person or disabled individual includes knowingly or intentionally engaging in one or more of the following acts:

  • Causes the penetration of the anus or sexual organ of a child by any means
  • Causes the sexual organ of a child to contact or penetrate the mouth, anus, or sexual organ of another person, including the actor
  • Causes the mouth of a child to contact the anus or sexual organ of another person, including the actor

When the assault involves a weapon, the threat of violence, or violence, prosecutors can elevate sexual assault charges to aggravated sexual assault charges. One or more of the following factors can result in a charge:

  • Administers or provides flunitrazepam (otherwise known as Rohypnol, gamma hydroxybutyrate, or ketamine) to the victim of the offense with the intent of facilitating the commission of the offense. These substances are commonly called “date rape” drugs.

For example, indecency with a child by exposure is a third-degree felony, and indecency with a child by contact is a second-degree felony. Aggravated sexual assault with a child is a first-degree felony that is punishable by a life-in-prison sentence.

When the victim of the sexual act is under age 6, prosecutors can bring “super aggravated” charges that result in a minimum prison sentence of 25 years to life in prison with no eligibility for parole.
